ประกาศกระทรวงสาธารณสุข (ฉบับที่ 441) พ.ศ. 2566 ออกตามความในพระราชบัญญัติอาหาร พ.ศ. 2522 เรื่อง ช็อกโกแลตและผลิตภัณฑ์ช็อกโกแลต
กระทรวงสาธารณสุขได้ปรับปรุงแก้ไขประกาศกระทรวงสาธารณสุขว่าด้วยช็อกโกแลต เพื่อให้มีความเหมาะสมกับสภาวการณ์ปัจจุบัน สอดคล้องกับมาตรฐานอาหารสากล คือ Standard for Chocolate and Chocolate Products (CODEX STAN 87 – 1981) Amended in 2016 และลดความซับซ้อนของกฎระเบียบ เกิดประโยชน์ในการบังคับใช้แก่เจ้าหน้าที่และผู้ประกอบการที่เกี่ยวข้อง โดยออกเป็นประกาศกระทรวงสาธารณสุข (ฉบับที่ 441) พ.ศ. 2566 ออกตามความในพระราชบัญญัติอาหาร พ.ศ. 2522 เรื่อง ช็อกโกแลตและผลิตภัณฑ์ช็อกโกแลต ลงวันที่ 16 พฤษภาคม พ.ศ. 2566 ซึ่งมีสาระสำคัญโดยสรุป ดังนี้
1. ยกเลิกประกาศกระทรวงสาธารณสุข จำนวน 2 ฉบับ ดังนี้
(1) ประกาศกระทรวงสาธารณสุข ฉบับที่ 83 (พ.ศ. 2527) เรื่อง ช็อกโกแลต ลงวันที่ 15 พฤศจิกายน 2527
(2) ประกาศกระทรวงสาธารณสุข เรื่อง ช็อกโกแลต (ฉบับที่ 2) ลงวันที่ 3 มีนาคม พ.ศ. 2554
2.กำหนดสถานะของการควบคุมช็อกโกแลตและผลิตภัณฑ์ช็อกโกแลต ให้เป็นอาหารที่กำหนดคุณภาพหรือมาตรฐาน โดยการดำเนินการขออนุญาตผลิตภัณฑ์ดังกล่าวต้องปฏิบัติตามระเบียบสำนักงานคณะกรรมการอาหารและยาว่าด้วยการดำเนินการเกี่ยวกับเลขสารบบอาหาร
3.กำหนดนิยามและขอบข่าย ดังนี้
“ช็อกโกแลต” หมายความว่า ผลิตภัณฑ์ที่มีลักษณะเป็นเนื้อเดียวกัน ผลิตขึ้นจากการนำเมล็ดโกโก้หรือวัตถุดิบที่ได้จากเมล็ดโกโก้มาผ่านกรรมวิธีที่เหมาะสม อาจมีการผสมองค์ประกอบของนม น้ำตาล วัตถุเจือปนอาหาร วัตถุแต่งกลิ่นรส ไขมันพืชอื่นนอกจากไขมันโกโก้ (cocoa butter)
“ผลิตภัณฑ์ช็อกโกแลต” หมายความว่า ช็อกโกแลตที่มีการเติมส่วนประกอบอื่นที่เป็นอาหารและไม่เป็นอันตรายต่อสุขภาพ นอกเหนือจากองค์ประกอบของนม น้ำตาล วัตถุเจือปนอาหาร วัตถุแต่งกลิ่นรส ไขมันพืชอื่นนอกจากไขมันโกโก้ (cocoa butter)

Food and Drug Administration, Ministry of Public Health has issued the Notification of the Ministry of Public Health (No.441) B.E.2566 (2023) Issued by virtue of the Food Act B.E. 2522 (1979) Re: Chocolate and Chocolate Products, dated the 16th of May of B.E.2566 (2023) in order to ensure the compatibility of the regulations for chocolate and chocolate products with current situations and international standards (The Standard for Chocolate and Chocolate Products; CODEX STAN 8 – 1981, Amended in 2016) as well as reduce redundancy of regulation for benefit of interested person. The following is the summary of the notification:
1.Two the notifications of the Ministry of Public Health are repealed.
(1) The Notification of Ministry of Public Health No.83 (1984) Re: Chocolate, dated November 15th, 1984.
(2) The Notification of Ministry of Public Health Re: Chocolate (No.2), dated March 3rd, 2011.
2.Chocolate and chocolate products are prescribed as food with mandatory standards and qualities, whose approval application shall adhere to the food serial number regulations of the Food and Drugs Administration.
3.Definitions and scopes are as follows:
“Chocolate” means the homogenous product obtained by an adequate manufacturing process from cocoa beans or cocoa materials, which may contain milk products, sugars, food additives, flavoring agents, and vegetable fats other than cocoa butter.
“Chocolate products” means “chocolate” with other edible, non-hazardous ingredients, excluding milk products, sugars, food additives, flavoring agents, and vegetable fats other than cocoa butter.
